1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Broker," or "you") and SurePortal ("Service," "we," "us," or "our") governing your access to and use of the SurePortal platform. By accessing or using SurePortal, you acknowledge that you have read, understood, and agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS SERVICE.

2. Service Description

SurePortal provides a secure, temporary data transmission platform designed specifically for insurance brokers to collect sensitive personal and financial information from their clients. The Service enables:

• Creation of secure, PIN-protected links for client data submission (links permit access for 30-60 minutes from first access)
• Temporary encrypted storage of submitted data
• One-time viewing of submitted data by authorized brokers
• Automatic, permanent deletion of data upon viewing, or within 7 days if never viewed

3. Account Registration and Security

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

4. Data Privacy and Security

Our data handling practices are detailed in our Privacy Policy. Key commitments include:

• Zero long-term retention of client-submitted data
• Automatic deletion upon viewing, or within 7 days if never viewed
• Encrypted in transit (TLS 1.2 or higher); client submissions are field-level encrypted (AES-256-GCM, keys held outside the database) on top of AES-256 database encryption at rest
• No sharing, selling, or unauthorized use of data

5. User Responsibilities

As a Broker using SurePortal, you agree to:

• Comply with all applicable laws and regulations (GLBA, state insurance laws, etc.)
• Only collect data you are legally authorized to obtain
• Not collect Protected Health Information (PHI) through the Service unless expressly permitted in writing and covered by a Business Associate Agreement
• Securely communicate PIN codes to clients through separate channels
• Use the Service solely for legitimate insurance business purposes
• Not attempt to circumvent security measures or access unauthorized data

6. Subscriptions, Billing, and Refunds

The Service offers a free tier and a paid "Pro" subscription. Pro subscriptions are billed monthly in advance through our payment processor at the price displayed at checkout, and renew automatically each month until cancelled.

• Cancellation: You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period, and you retain Pro access until then.
• 30-Day Money-Back Guarantee: First-time Pro subscribers may request a full refund of their first subscription payment within 30 days of the initial purchase by emailing support@surehelp.app. Refunds are issued to the original payment method. The guarantee applies once per customer and does not apply to renewal payments.
• Price changes:We may change subscription pricing with at least 30 days' advance notice; changes take effect at your next billing period.

7. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUREPORTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or any other reason at our sole discretion.

9. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or Service notification. Continued use after changes constitutes acceptance.
